RE-MARRIAGE AFTER IRREVOCABLE IN ISLAM - TALAQ

 



After the pronouncement of the tripple divorce or Irrevocable divorce, if the man again wants to Marry the woman after realizing that he had committed a blunder by divorcing her there is a Remote possibility after going through an extremely difficult procedure. The Qur'an says:

"And if he hath divorced her (the third time) then she is not lawful unto him thereafter until she hath weded another husband. Then if he (another husband) divorces her, it is no sin for both of them to come together again if they consider that they are able to observe the limits of Allah these are the limit of Allah".

In other words, the process is of such a nature that the woman whole second marriage has been  Consummated can only be free if the other man divorce her. This is the lesson for one who treats Talãq light-heartedly or divorces his wife on flimsy ground.

SOME GENERAL REGULATIONS CONCERNING THE TALÃQ

When one divorces his wife, it is necessary for him to know that the dowry (mahr) settled on the wife cannot be taken back, unless the wife is guilty of adultery. The divorce must be pronounced in presense of witness just as in the case of marriage. It is a public act to be known by all. Once Imran was asked about a man who divorced his wife then he had intercourse with her, and he did not call in witness on the occasion of the divorce,  nor on taking her back.

The wife I s considered to be divorced Imran bin Anas says that in all cases where is no information about the husband, the wife should wait for four years and may marry after the completion of this period. Imam Bukhari has qooted a hadith from Ibn al-Musayyab who said: "When a person is found missing while fighting his wife shall wait for one year".
